Section 26.19.01.08 - Review Procedures for Drilling and Operating in the Chesapeake Bay Critical Area

A. Following receipt of a permit application for a project located in the Chesapeake Bay Critical Area, the Department shall send a copy of the permit application and all accompanying documents to the Chesapeake Bay Critical Area Commission for review and recommendations.

B. The Chesapeake Bay Critical Area Commission shall submit written recommendations on the application to the Department within 150 days of receipt of the application and accompanying documents.

C. Following receipt of the recommendations by the Chesapeake Bay Critical Area Commission on the application, the Department shall adopt, to the maximum extent permitted by law, permit conditions recommended by the Chesapeake Bay Critical Area Commission.
