Third, consistent with CBD v. Salazar and Conner v. Burford, NSO lessees may be able to enter into “unitization” or “communitization agreements” with nearby federal lessees and thereby directionally drill into the leased federal minerals from other leased land that is not encumbered by an NSO provision.
