Plaintiff David Rocco was arrested on or about May 21, 2014, on a charge of violating N.J.S.A. §2C:14-4(B)(1), “Lewdness Observed by Children Under 13.” See Kapusinski Certification and Exhibit “A” thereto, submitted contemporaneously. 2. On or about September 10, 2014, Plaintiff pled guilty to an amended charge of violating N.J.S.A. §2C:14-4(A), DAVID ROCCO, Plaintiff, vs. BERGEN COUNTY and CORIZON, Defendants. Mr. Rocco was sentenced by the New Jersey Superior Court on or about November 14, 2014 to time served (162 days) plus 1 year probation. Id. 4. When Plaintiff was sentenced he had private counsel. Id. 5. The Judgement of Conviction relates that Mr. Rocco was in the custody of the Bergen County Jail from June 6, 2014 until November 14, 2014. Id. 5. Mr. Rocco never appealed nor did he otherwise seek to undo his guilty plea. See Kapusinski Cert., ¶3. 6. Mr. Rocco is not, as of September 7, 2016, in the Bergen County Jail. Id.
