P. 12(b)(6), Defendant Beaulieu Group LLC (“Beaulieu”) respectfully requests that this Court dismiss in its entirety with prejudice the Amended Complaint brought by Plaintiff Mohawk Carpet Distribution, Inc. (“Mohawk”) for failure to state a claim upon which relief can be granted. I. INTRODUCTION Mohawk’s Amended Complaint, like its original Complaint, alleges that Beaulieu is infringing Mohawk’s WELDLOK trademark for a ‘locking’ carpet backing by using Beaulieu’s own federally registered incontestable trademark Case 1:16-cv-02763-TCB Document 15-1 Filed 09/22/16 Page 1 of 79 2 OMNI LOC for carpet backing. Obviously, this is entirely frivolous - the point of incontestable federal trademark registration is that it gives its holder the right to exclusive use of that trademark. Furthermore, OMNI and WELD are not remotely similar, and “lock” (or Beaulieu’s variation “loc” or Mohawk’s variation “lok”) is a common descriptive suffix for carpet backing (one that is used by most companies who sell carpet backing), which “locks” carpet to the floor. Unsurprisingly given these unavoidable obstacles to its claims, Mohawk’s Amended Complaint consists of little more than formulaic legal conclusions, and the only facts alleged are insufficient to plead trademark infringement of the claimed WELDLOK mark by Beaulieu’s use of OMNI LOC. Mohawk fails to allege superior rights, and in fact cannot allege superior rights given Beaulieu’s incontestable and long-standing federal trademark registration for OMNI LOC. Mohawk’s amendments to its Complaint consist of little more than window- dressing designed to obscure the weakness of Mohawk’s allegations, and do not in any way cure the fundamental flaws in Mohawk’s claims, which, as the Court knows, are also subject to a pending Rule 11 motion. II. FACTUAL ALLEGATIONS Mohawk alleges that it owns both a federal trademark registration for WELDLOK (Reg. No. 1051944) and common law trademark rights in connection Case 1:16-cv-02763-TCB Document 15-1 Filed 09/22/16 Page 2 of 79 3 with “carpet backing.” Amended Compl. (“FAC”) ¶¶ 13-23.1 Mohawk claims that it and its predecessors in interest have used WELDLOK on carpet backing for the past forty years, continuously since 1976. Id. ¶¶ 14-16. Mohawk also claims that it currently uses its WELDLOK Mark in connection with “carpet cleaning products.” Id. ¶ 18. Mohawk states that its WELDLOK brand has been “backed by major advertising and promotional efforts” and that Mohawk “has invested a substantial amount of time, money, and other resources in promoting” its WELDLOK brand in the United States. Id. ¶¶ 24-25. Mohawk alleges that Beaulieu “offer[s] to sell, has sold, and continues to sell carpet backing products featuring such carpet backing under the Omni Loc name in commerce throughout the United States.” Id. ¶ 30. The Amended Complaint recognizes that Beaulieu owns the federal registration (Reg. No. 3740645) for OMNI LOC in connection with carpet backing, id. ¶ 31, but does no more than hint at the fact that Beaulieu’s registration is actually incontestable, id. ¶ 35.2 The Amended Complaint alleges that Mohawk and Beaulieu compete in 1 Mohawk spends several paragraphs alleging that it owns a common law trademark in WELDLOK for carpet backing, see FAC ¶¶ 14. 2 See attached Exhibit A. Id. ¶ 29. III. STANDARD OF REVIEW In order to survive a motion to dismiss under Fed. R. Civ. P. 12(b)(6), a complaint must “plead all facts establishing an entitlement to relief with more than ‘labels and conclusions’ or a ‘formulaic recitation of the elements of a cause of action.’” Resnick v. AvMed, Inc., 693 F.3d 1317, 1324 (11th Cir. 2012) (quoting Bell Atl. Corp. v. Twombly, 550 U.S. 544, 555, 127 S. Ct. 1955, 167 L.Ed.2d 929 (2007)). A pleading must contain “a short and plain statement of the claim showing that the pleader is entitled to relief.” Fed.R.Civ.P. 8(a)(2). The purpose of Fed. R. Civ. P. 8(a)(2) is to provide defendants with fair notice of what claim is being alleged and the grounds upon which it rests. Davis v. Coca-Cola Bottling Co. Consol., 516 F.3d 955, 974 (11th Cir. 2008) (citations omitted). “The complaint must contain enough facts to make a claim for relief plausible on its face.” Twombly, 550 U.S. at 1324-25. “[O]nly a complaint that states a plausible claim for relief survives a motion to dismiss.” Iqbal, 556 U.S. at take judicial notice.”); Drew Estate Holding Co., LLC v. Fantasia Distribution, Inc., No. 11-21900-CIV, 2012 WL 234105, at *3 (S.D. Fla. Jan. 24, 2012) (taking judicial notice of trademark registration on motion to dismiss). Case 1:16-cv-02763-TCB Document 15-1 Filed 09/22/16 Page 4 of 79 5 679 (citing Twombly, 550 U.S. at 556). “A claim has facial plausibility when the plaintiff pleads factual content that allows the court to draw the reasonable inference that the defendant is liable for the misconduct alleged.” Id. at 678 (citing Twombly, 550 U.S. at 556). Although it is axiomatic that the Court must accept as true all of the fact allegations contained in the complaint, this tenet is “inapplicable to legal conclusions.” Id. at 678. “While legal conclusions can provide the framework of a complaint, they must be supported by factual allegations.” Id. at 679. IV. ARGUMENT In order to plead a claim for trademark infringement, Mohawk must allege facts which demonstrate the following elements: (1) its mark has legal priority, (2) defendant used its mark in commerce, and (3) defendant’s mark is likely to cause consumer confusion. See, e.g., Int’l Cosmetics Exch., Inc. v. Gapardis Health & Beauty, Inc., 303 F.3d 1242, 1248 (11th Cir. 2002); Davidoff & CIE, S.A. v. PLD Int’l Corp., 263 F.3d 1297, 1300-01 (11th Cir. 2001); Lone Star Steakhouse & Saloon, Inc. v. Longhorn Steaks, Inc., 122 F.3d 1379, 1382 (11th Cir. 1997). Mohawk’s Amended Complaint fails to sufficiently allege that Mohawk has prior rights, as that is defined in the law, or that there is a likelihood of confusion, and thus fails to state a claim for trademark infringement under the Lanham Act. Case 1:16-cv-02763-TCB Document 15-1 Filed 09/22/16 Page 5 of 79 6 Because the test for federal unfair competition and for a violation of the Georgia Deceptive Trade Practices Act is the same as the test for trademark infringement, Mohawk has failed to state a claim with respect to these causes of action as well. Tana v. Dantanna’s, 611 F.3d 767, 772 (11th Cir. 2010) (assuming test for federal trademark infringement and violation of Georgia Deceptive Trade Practices Act was the same); Ross Bicycles, Inc. v. Cycles USA, Inc., 765 F.2d 1502, 1503-04 (11th Cir. 1985), cert. denied 475 U.S. 1013 (1986) (holding test for trademark infringement was same as test for unfair competition). A. Mohawk Cannot State a Plausible Claim for Relief Because Beaulieu Owns an Incontestable Registration for OMNI LOC. Each of Mohawk’s claims set out in the Amended Complaint must fail, by law, for one simple reason: Beaulieu owns an incontestable federal trademark registration for OMNI LOC in connection with carpet backing, the precise goods Mohawk alleges “infringe” its rights. See Ex. A. Mohawk’s legal conclusion that it has priority and superior rights with respect to OMNI LOC is thus directly undermined by publicly available records. 1. Beaulieu’s Incontestable Federal Registration Is an Absolute Shield from the Claims in the Amended Complaint The Lanham Act provides that the status of incontestability is “conclusive evidence” of the registrant’s “exclusive right to use the mark on or in connection Case 1:16-cv-02763-TCB Document 15-1 Filed 09/22/16 Page 6 of 79 7 with the goods or services specified” in the affidavit supporting incontestability status. See 15 U.S.C. § 1115(b) (“[an incontestable registration] shall be conclusive evidence of . . . the registrant’s exclusive right to use the registered mark in commerce”); 15 U.S.C. § 1065 (“the right of the owner to use . . . [an incontestable registered mark] in commerce for the goods or services on or in connection with which such registered mark has been in continuous use . . . shall be incontestable”); Robert B. Vance & Associates, Inc. v. Baronet Corp., 487 F. Supp. 790, 796 (N.D. Ga. 1979) (“As a general rule, if a trademark has become incontestable under 15 U.S.C. § 1065, as in the instant case, the mark’s registration serves as conclusive evidence of the registrant’s exclusive right to use the registered mark.”). Mohawk in fact admits in its Amended Complaint that an incontestable trademark registration serves as “conclusive evidence” of the right to “exclusive use” of the registered trademark in connection with the registered goods. FAC ¶ 22. Underscoring Beaulieu’s exclusive right to use its incontestable mark, the incontestability status has the further effect of precluding certain avenues of attacking the trademark. Crucially, “[t]he major practical effect of incontestability is to cut off two of the most important challenges to the status of an incontestable mark[, including] that the mark is inferior in priority to the challenger’s previously Case 1:16-cv-02763-TCB Document 15-1 Filed 09/22/16 Page 7 of 79 8 used mark.” Wallace Int’l Silversmiths, Inc. v. Wallace Cos., Inc., No. CV88-PT- 0021-S, 1988 WL 268169, *2, 7 U.S.P.Q. 2d 1723 (N.D. Ala. Apr. 26, 1988) (emphasis added) (where defendant counterclaimed for trademark infringement and plaintiff owned incontestable federal registrations for challenged marks, “this court can reach no other conclusion than the mark [in issue] being incontestable under § 33 of the Lanham Act may not be challenged on the grounds of defendant’s prior use”). See also Haviland & Co. v. Johann Haviland China Corp., 269 F. Supp. 928, 955 (S.D.N.Y. 1967) (the right to use “trademarks which have become incontestable under the Lanham Act . . . are protected against attack . . . despite any claim . . . of prior or superior rights”). Professor McCarthy has described the effect of an incontestable federal registration in situations such as this lawsuit as creating a “safe harbor” for a defendant like Beaulieu: “[I]f a defendant in an infringement lawsuit is the owner of a valid incontestable registration, its use of the mark on those goods or services is secure and cannot be disturbed. This creates a safe harbor for that mark as used on those goods or services.” See 6 McCarthy on Trademarks and Unfair Competition § 32:141 (4th ed.) (emphasis added). Mohawk’s Attempts to Rely on § 1065 and § 1115(b) of the Lanham Act to Attack Beaulieu’s Incontestable Mark Fail Mohawk includes several allegations in the Amended Complaint apparently designed to get around Beaulieu’s incontestable registration and establish priority. See FAC ¶¶ 35-37. Those paragraphs largely consist of legal conclusions - dressed up as facts - about how Mohawk would prefer the Lanham Act to be interpreted. See id.; see also Bell Atl. Corp. v. Twombly, 550 U.S. 544, 555 (2007) (admonishing courts to disregard “legal conclusion[s] couched as . . . factual allegation[s]” when analyzing Rule 12(b)(6) motions). Therein, Mohawk alleges that it has priority over Beaulieu’s OMNI LOC mark because Mohawk has been using WELDLOK continuously since before Beaulieu adopted OMNI LOC, relying on §§ 1065 and 1115(b) of the Lanham Act. However, neither of those provisions permit the Amended Complaint’s claims as against Beaulieu’s incontestable mark-and, in fact, as described above, the law is quite specific that use of a mark before defendant started using its mark is of absolutely no consequence where the defendant has obtained an incontestable trademark registration in the mark alleged to be infringing. Case 1:16-cv-02763-TCB Document 15-1 Filed 09/22/16 Page 9 of 79 10 a. 15 U.S.C. § 1115(b) Does Not Allow Mohawk to Establish Priority Over Beaulieu’s Incontestable Registration. First, Mohawk alleges that it can establish priority under two subsections of § 1115(b). See FAC ¶¶ 35-37. That provision lays out nine “incontestability defenses”, two of which involve circumstances where the party seeking to attack an incontestable registration either registered or began using its own mark before the incontestable registration. See 15 U.S.C. § 1115(b)(5-6) (herein, the “§ 1115 prior use defenses”). Mohawk tries to establish in the Amended Complaint that because it alleges that it used and registered WELDLOK before Beaulieu first registered OMNI LOC, Mohawk has priority. But, in an example of Mohawk’s willingness to argue anything no matter how contrary to black-letter law, § 1115 is a defense to trademark infringement. It does not give one the right to sue the owner of an incontestable mark. Thus, the applicability of the § 1115 prior use defenses turns on which party is raising those defenses and in what circumstances: the defense can be raised where the owner of the incontestable mark at issue (here, that would be Beaulieu) is charging another party with infringement. See id. § 1115(b)(5) (providing defense for “the mark whose use by a party is charged as an infringement” if certain conditions are met) (emphasis added); § 1115(b)(6) (same). Here, Beaulieu is not suing Mohawk for trademark infringement, and so Case 1:16-cv-02763-TCB Document 15-1 Filed 09/22/16 Page 10 of 79 11 by the plain language of the statute, the § 1115(b) priority defenses are inapplicable. To argue otherwise would be frivolous. Accordingly, courts in this Circuit, on facts parallel to those alleged by Mohawk, have found that an incontestable mark cannot be challenged on the ground that it is inferior in priority to the challenger’s mark. See Wallace, 1988 WL 268169, *2 (where defendant counterclaimed for trademark infringement involving plaintiff’s incontestable mark, “this court can reach no other conclusion than the mark ‘Wallace’ being incontestable under § 33 of the Lanham Act may not be challenged on the grounds of defendant’s prior use”). Therefore, even taking all of the factual allegations in the Amended Complaint as true, Mohawk cannot rely on the § 1115 priority defenses to establish the priority element of trademark infringement. b. 15 U.S.C. § 1065 Also Does Not Allow Mohawk to Establish Priority Over Beaulieu’s Incontestable Registration. Mohawk’s attempt to rely on § 1065 to establish priority are equally futile. Section 1065 sets out the conditions under which a registered mark can become incontestable, excluding any mark “to the extent, if any, . . . [it] infringes a valid right acquired under the law of any State or Territory by use of a mark or trade name continuing from a date prior to the date of registration.” See 15 U.S.C. § 1065 (emphasis added). The logical and only reading of the statute that is in Case 1:16-cv-02763-TCB Document 15-1 Filed 09/22/16 Page 11 of 79 12 accord with the rest of the statute, is to clarify (in keeping with 15 U.S.C. § 1115(b)(5)-(6)) that an incontestable federal trademark registration will not destroy validly acquired state law rights. There is no support for the theory that this language can be read to directly contradict 15 U.S.C. § 1115(b), and create an additional ground on which an incontestable trademark registration can be attacked to eliminate the absolute defense to an infringement claim. That § 1065 reflects only a defense of prior use to has been conclusively decided by the Eleventh Circuit. In Sovereign Military Hospitaller Order of Saint John of Jerusalem of Rhodes & of Malta v. Florida Priory of the Knights Hospitallers of the Sovereign Order of Saint John of Jerusalem, Knights of Malta, The Ecumenical Order, the Court held that: “section 1065 of the Lanham Act - the provision that defines incontestability-also contains a defense of prior use.” 809 F.3d 1171, 1185 (11th Cir. 2015). Furthermore, even were one to credit Mohawk’s theory that an incontestable federal trademark registration can be found to affirmatively infringe based on state law rights, Mohawk has not stated such a claim here. The Amended Complaint does not allege facts (as opposed to bald legal conclusions) that could show that Mohawk has acquired any state-specific trademark rights to use WELDLOK. The Amended Complaint alleges only that Mohawk uses WELDLOK throughout the Case 1:16-cv-02763-TCB Document 15-1 Filed 09/22/16 Page 12 of 79 13 United States, apparently in an effort to broadly sweep every state and territory within its scope. See FAC ¶ 35-37. On its face, the Amended Complaint does not plead ownership of any state trademark registrations, or other state-specific rights, making it entirely implausible for Mohawk to rely on § 1065 were that argument not already specious. Finally, to the extent that § 1065 allowed for an affirmative infringement claim under state law (an interpretation which contradicts the purpose of the statute and applicable Supreme Court authority), such a claim would have to be brought pursuant to state law (as specifically referenced in the statute), and could not be brought as a claim for federal trademark infringement under the Lanham Act. The Amended Complaint simply does not allege that Beaulieu has infringed state law trademark rights. The Amended Complaint only alleges infringement of Mohawk’s registered WELDLOK Mark. See FAC at 16 (setting out COUNT ONE: “Infringement of a Federally Registered Trademark”). See Sovereign Military Hospitaller Order of Saint John of Jerusalem of Rhodes & of Malta, 809 F.3d at 1185 (“The defense of prior use in section 1065 turns on state law.”). Consequently, for many reasons, Mohawk cannot rely on § 1065 to circumvent Beaulieu’s incontestable registration. Case 1:16-cv-02763-TCB Document 15-1 Filed 09/22/16 Page 13 of 79 14 3. The Amended Complaint Runs Counter to Trademark Law To allow Mohawk to maintain a lawsuit against Beaulieu for Beaulieu’s use of its own incontestable registered trademark would be to upend trademark law. The entire purpose of an incontestable federal trademark registration is to “quiet title” to a trademark. Park ‘N Fly, Inc. v. Dollar Park & Fly, Inc., 469 U.S. 189, 198 (1985) (“The incontestability provisions, as the proponents of the Lanham Act emphasized, provide a means for the registrant to quiet title in the ownership of his mark.”). If Mohawk is allowed to pursue this lawsuit, it essentially renders an incontestable federal trademark registration meaningless. Furthermore, Mohawk’s claims are directly contrary to statute because Mohawk is trying to do what the statute does now allow it to do: cancel Beaulieu’s incontestable registration for OMNI LOC. Mohawk has not pleaded a separate claim for cancellation, but it is seeking to “permanently enjoin[]” Beaulieu from using Beaulieu’s own OMNI LOC mark. See FAC at 25. As explained above, Beaulieu’s incontestable registration means that Beaulieu has the exclusive right to use OMNI LOC in connection with carpet backing. Mohawk is attempting to completely strip away and effectively cancel Beaulieu’s rights to use OMNI LOC with carpet backing. Under the Lanham Act, an incontestable trademark registration can be cancelled only under certain enumerated circumstances, such as Case 1:16-cv-02763-TCB Document 15-1 Filed 09/22/16 Page 14 of 79 15 fraud or abandonment. See 15 U.S.C. §§ 1064, 1115(b). Likelihood of confusion with a prior mark is not grounds for cancelling an incontestable registration. Id.; see Sovereign Military Hospitaller Order of Saint John of Jerusalem of Rhodes & of Malta, 809 F.3d at 1185 (holding “the Lanham Act expressly limits the effect of those defenses [of prior use]” with respect to an incontestable trademark). Mohawk cannot attempt an end run around the Lanham Act by filing a frivolous federal lawsuit.3 Because Beaulieu has superior and incontestable rights in OMNI LOC, Mohawk has failed to allege priority as defined by the law, and thus fails to state a claim for trademark infringement, unfair competition, or violation of Georgia law. B. All of Mohawk’s Claims Should Be Dismissed Because Mohawk Does Not and Cannot Allege a Likelihood of Confusion Even setting aside Beaulieu’s incontestable federal registration for OMNI LOC (which conclusively settles the question), this is not a case where the USPTO inadvertently allowed registration of a confusingly similar mark. OMNI LOC, as a matter of law, is not confusingly similar to WELDLOK. Case 1:16-cv-02763-TCB Document 15-1 Filed 09/22/16 Page 15 of 79 16 OMNI LOC, with which Mohawk’s WELDLOK has coexisted since 2008, creates a likelihood of confusion-is entirely implausible on its face.4 In a trademark infringement case, if the conflicting marks are overwhelmingly dissimilar, a dismissal of the infringement claim is proper even if all of the other factors tip in favor of the plaintiff. Dippin’ Dots, Inc. v. Frosty Bites Distrib., LLC, 369 F.3d 1197, 70 U.S.P.Q.2d 1707 (11th Cir. 2004). Here, the dominant portions of the marks “WELD” for WELDLOK and “OMNI” for OMNI LOC, are entirely dissimilar in sight, meaning, and pronunciation. See 4 McCarthy on Trademarks and Unfair Competition § 23:21 (4th ed.) (conflicting marks are to be compared with respect to similarity of pronunciation, appearance, and verbal translation). Mohawk does not allege any similar stylization of the marks, so the allegation of confusing similarity apparently rests of the similarity of 4 In pursuit of a highly anti-competitive strategy and as retaliation for Beaulieu’s filing of trademark litigation against Mohawk in 2015, this summer, Mohawk filed a series of intellectual property lawsuits against Beaulieu, all frivolous on their faces. See Mohawk Carpet Distrib., Inc. v. Beaulieu Grp., LLC, Case No. 1:16-cv- 02266-WSD (N.D. Ga.) (action filed June 27, 2016); Mohawk Carpet Distrib., Inc. v. Beaulieu Grp. LLC, Case No. 1:16-cv-03018-AT (N.D. Ga.) (action filed August 18, 2016). Additional facts would show the additional sanctionable nature of the filing at hand, but, here, Beaulieu limits its discussion to the Amended Complaint, which is dismissible pursuant to Rule 12(b). Beaulieu intends to seek attorneys’ fees under 15 U.S.C. § 1117(a), and has filed a motion for sanctions against Mohawk pursuant to Fed. R. Civ. P. 11. Case 1:16-cv-02763-TCB Document 15-1 Filed 09/22/16 Page 16 of 79 17 the words alone, and the similarity of the words alone appears limited to the suffix “LOC”, though even here, Mohawk’s mark spells the suffix differently as “LOK.” Nor does the fact that both alleged marks share the common suffix “loc[k]” create any confusing similarity. Mohawk cannot claim exclusive rights in the syllable “lok/c/ck”, even in connection with carpet backing. This is readily apparent because there are many other federal trademark registrations for marks using “loc/k/ck” in connection with carpet backing. A simple search of the USPTO for federally registered trademarks for carpet backing (hardly an enormous category) turns up the following: • EXTRALOC (Reg. No. 1822049, incontestable) for backing for carpet; • VINYLOC (Reg. No. 1415115, incontestable) for carpet backing sold as a component of carpeting; • SUPER-LOK (Reg. No. 4589858) for carpet backing; • ENVIROLOC (Reg. No. 4122127) for backing for carpet; • FIBER-LOCK (Reg. No. 2591549) for carpet cushion; • DUBL-LOC (Reg. No. 2658765, incontestable) for carpet underlay; • ULTRA-LOC (Reg. No. 1216880, incontestable) for carpet manufactured using a synthetic secondary backing web; • LOK-LIFT (Reg. No. 1426643, incontestable) for floor covering, namely, scrim material to be interposed between carpet and surface to anchor carpet in place; Case 1:16-cv-02763-TCB Document 15-1 Filed 09/22/16 Page 17 of 79 18 • LIFELOC (Reg. No. 3708326) for carpet backing;5 • DUO-LOCK (Reg. No. 4521659) for carpet underlays, namely, rug grippers; • ECONO-LOCK (Reg. No. 4521657) for carpet underlays, namely, rug grippers; • TRIPLE-LOCK (Reg. No. 4748212) for carpet underlays, namely, rug grippers; • SUPERIOR-LOCK (Reg. No. 4877770) for carpet underlays, namely, rug grippers; • PREMIUMLOCK (Reg. No. 3893602) for carpet underlays, namely, rug grippers; and • SUPER-LOCK NATURAL (Reg. No. 4895879) for carpet underlays, namely, rug grippers made of natural rubber. Copies of federal TSDR reports for these marks are attached hereto as Exhibit B. If you widen the criteria to similar trademarks related to “carpet”, the list is even longer. Therefore, as a matter of law, in a field where “loc/k/ck” is a commonly used descriptive suffix (which it is here, as carpet backing “locks” carpet to the floor) that commonality alone cannot create a likelihood of confusion. 5 Mohawk owns LIFELOC, and registered it in 2009, with a first use date in 2009. Since this is subsequent to Beaulieu’s registration of OMNI LOC, under Mohawk’s creative interpretation of trademark law, that mark would be infringing OMNI LOC. Sept. 27, 1973) (holding that SLEEVE-LOK and G-LOC used in connection with the same goods were not confusingly similar because: “‘LOCK’, ‘LOK’, or ‘LOC’ have been so commonly adopted and registered as a portion of marks in the construction industry . . . that the presence of this term as a common suffix affords no basis by itself upon which to predicate a holding that the marks are confusingly similar”); Crawford Fitting Co. v. C. B. Crawford Co., 135 U.S.P.Q. (BNA) 381, 1962 WL 8668, at *2 (T.T.A.B. Oct. 5, 1962) (finding no likelihood of confusion between SWAGELOK in connection with tube couplings and TYLOK in connection with tube couplings because the sole resemblance between the marks was the descriptive suffix “lok” and third parties in the same industry also used “lok” without confusion); In Re Amteco, Inc., Serial No. 75/086,733, 1999 WL 421022, at *3 (T.T.A.B. June 18, 1999) (citing large number of marks in same metal paint/coating/sealant field that used variations on “lock” and holding that there was no likelihood of confusion between LOX-RUST on rust preventive paint and LOX- SEAL on coatings for automotive industry). Furthermore, in granting Beaulieu a federal registration for OMNI LOC for identical goods to WELDLOK, the USPTO already determined that the marks are not confusingly similar, and Mohawk does not allege any additional facts which Case 1:16-cv-02763-TCB Document 15-1 Filed 09/22/16 Page 19 of 79 20 would alter that analysis. There has been no actual confusion alleged, nor could there be. Given the overwhelming dissimilarity between the marks, and the lack of factual allegations (as opposed to threadbare recitals or legal conclusions) as to the remaining likelihood of confusion factors, Mohawk has failed to allege a likelihood of confusion sufficient to survive a motion to dismiss. C. Count Three of the Amended Complaint Should Be Dismissed for the Further Reason that Mohawk has Not Alleged Facts that Beaulieu Uses the Mark with Carpeting Finally, Count Three of the Amended Complaint, which alleges a claim for violation of the Georgia Deceptive Trade Practices Act, O.C.G.A. §§ 10-1-370 et seq., must also be dismissed for all of the reasons set forth above. In addition, in raising that claim, Mohawk claims that Beaulieu has engaged in an unlawful deceptive trade practice by Beaulieu’s use of OMNI LOC “in connection with the distribution, marketing, promotion, offering for sale, and sale of carpeting.” See FAC ¶¶ 67-68 (emphasis added). But Mohawk has not laid out a single allegation that Beaulieu uses OMNI LOC with carpeting, as opposed to carpet backing. See id. ¶¶ 28-45. See, e.g., Se. Clinical Nutrition Ctrs., Inc. v. Mayo Found. For Medical Educ. & Research, 135 F. Supp. 3d 1267, 1274 (N.D. Therefore, even taking all the allegations in the Amended Complaint as true, Mohawk has failed to state a claim for relief under Count Three, and that claim should be dismissed. V. CONCLUSION For the foregoing reasons, Beaulieu respectfully requests that the Court dismiss Mohawk’s Complaint in its entirety with prejudice.
