This cause of action arises under the Federal Employers’ Liability Act, 45 U.S.C. § 51, et seq. and seeks to recover damages for an injury sustained by Plaintiff, Cory Henman, on October 1, 2013 while working for the Defendant in East Chicago, IN. 2. At the time this cause of action arose, Plaintiff had a bankruptcy case pending in the Northern District of Indiana as Case No. 10-24333. 3. On January 14, 2014, while his bankruptcy case was still pending, Plaintiff filed a Complaint against IHB in the Circuit Court of Cook County, Illinois (“Cook County litigation”) as a result of the occurrence alleged in the instant case. Plaintiff received a discharge in bankruptcy from the Northern District of Indiana and his bankruptcy case was closed on July 9, 2014, while the Cook County litigation remained pending. 5. Pursuant to a motion filed by IHB, the Cook County litigation was dismissed on the basis of the doctrine of Forum non Conveniens in October, 2014. 6. The instant case was filed in the Northern District of Indiana, Hammond Division, on November 25, 2014. 7. At no time did Plaintiff disclose his interest in this cause of action to the U.S. Bankruptcy Court. As a result, Plaintiff lacks standing to proceed against IHB in the present lawsuit. 8. Because the facts as stated above are undisputed, Defendant is entitled to judgment as a matter of law, as more fully set forth in IHB’s Brief in Support of its Motion for Summary Judgment.
