REQUESTS
REQUESTNO~ 1: On or around August 13, 2015, Plaintiff notified Defendant's
Topeka, KS, P~ant manager; John Butler, and office manager, Donna Younger, that Plaintiff filed
a Discrimination Complaintwitlithe E.E.O.C.
RESPONSE: Defendant admits that on August 13, 2015, Plaintiff delivered an
envelope to John Butler and asked that the envelope contents be placed in his file. The
envelope contents was a copy of an E.E.O.C. complaint filed by Plaintiff. All other
allegations in the request are denied.
REQUEST NO. 2: On or around June 18th, 2015, Plaintiff and Defendant's Topeka,

RESPONSE: · Defendant admits that on June 18 and 19, 2015, safety training
required by Defendant corporation occurred and Plaintiff and John Butler participated.
REQUESTNO. 4: (Note: There was no Request No. 3) Defendant's Topeka, KS,
office manager, Donna Younger, received disciplinary action in 2014 for committing battery on
an AmericanPhoenix shift supervisor, e.g., choking him/putting her hands around his neck
without his permission or consent, on the production floor, on her shift.
RESPONSE: OBJECTION. This request seeks information that is private
personnel information -regarding an employee that is not Plaintiff. By way of further
objection, this request seeks information that is not relevant and is not reasonably
calculated to lead. to -admissible evidence. Without waiving the foregoing objection, the
request is denied.
REQUEST NO. 5: --The Defendant compelled under threat of disciplinary action, up to
termination, plaintiff to immediately report injury, sickness, health and/or safety hazards.
RESPONSE: 9bjection: This request is vague and ambiguous. Without waiving
the- foregoing objection, Defendant admits_ that it· has policies in place that require
employees to report injuries,- accidents, or unsafe work conditions to supervisors either
immediately or by the end of the shift. All other allegations in this Request are denied.
REQUEST NO. 6: Defendant's former Topeka, KS, plant manager, Phil Curtis, in
2014, terminated the employment of multiple American Phoenix, Topeka, KS, employees for
one or more of the reasons alleged for plaintiffs termination, and for other reasons, but the
defendant's pre-weigh manager, Jeff Menard, re-hired and/or overruled the termination of some
of them within 14 days.

REQUEST NO. 7: Defendant's pre-weigh manager, Jeff Menard, has yelled,
screamed and cursed at employees of American Phoenix, Inc.
RESPONSE: Objection. This Request seeks information that is not relevant to the
issues in this case and is not likely to lead to the discovery of admissible evidence. Without
waiving the foregoing objections, if Jeff Menard yelled, screamed and cursed at employees
of American Phoenix, Inc., such actions were not ordered or condoned by the Defendant.
Accordingly, the allegations contained in this Request are denied.
REQUEST NO. 8: Defendant's Topeka, KS, office manager, Donna Younger, has
been accused of/re_ported to have been investigated for/been reprimanded for and/or has been
disciplined for lying to and/or about any American Phoenix employee.
RESPONSE: Objection. This Request seeks information that is irrelevant and is
not likely to lead to the discovery of admissible evidence. Additionally, the information
sought by this Request is private and confidential personnel information for an employee
other than the Plaintiff to which the employee has the right to privacy. Accordingly, the
allegations in this requestare denied.
REQUEST NO. 9: Defendant's Topeka, KS, office manager, Donna Younger, has
falsified information, document reports, memorandum [sic] and/or correspondence to or about
any American Phoenix employee, matter, or incident.
RESPONSE: Objection. This Request seeks information that is irrelevant and is
not likely to lead to the discovery of admissible evidence. Additionally, the information
sought by this Request is private and confidential personnel information for an employee
other than the Plaintiff to which the employee has the right to privacy. Accordingly, the

allegations in this Request are denied.
REQUEST NO. 10: Defendant's pre-weigh manager, Jeff Menard, has publically (i., e.,
in front of other American Phoenix employees) referred to Donna Younger (defendant's Topeka,
KS, office manager) as a "lying bitch".
RESPONSE: Objection. This Request seeks information that is not relevant to the
issues in this case and is not likely to lead to the discovery of admissible evidence. Without
waiving the foregoing objections, if Jeff Menard yelled, screamed and cursed at employees
of American Phoenix, Inc., such actions were not ordered or condoned by the Defendant.
Accordingly, the allegations contained in this Request are denied.
REQUEST N0.11: Defendant's Topeka, KS, plant manager, John Butler, is a self-
admitted former cocaine and/or methamphetamine addict.
RESPONSE: Objection. This Request seeks information that is irrelevant to the
issues in this case and is not reasonably calculated to lead to the discovery of admissible
evidence. Accordingly, the Defendant will neither admit nor deny the allegations contained
in this Request.
REQUEST NO. 12: Defendant's Topeka, KS, plant manager, Jolm Butler, did not
direct plaintiff to report to the hospital and take a drug test.
RESPONSE: Defendant admits that on or about August 28, 2015, plant manager
John Butler scheduled an appointment for the Plaintiff, or assisted the Plaintiff in
scheduling an appointment with Stormont-Vail WorkCare for August 28, 2015, for a
toxicology test at Plaintiff's request. The Defendant relied upon Stormont-Vail WorkCare
to perform whatever types of tests it deemed appropriate in its medical expertise, including
a drug test if that is what Stormont-Vail WorkCare doctors deemed appropriate. All other

allegations inconsistent with the foregoing are denied.
REQUEST NO. 13: Defendant's Topeka, KS plant, after plaintiffs termination,
temporarily or permanently employed Shannon Barnett as a maintenance technician.
RESPONSE: Objection. This Request seeks information that is irrelevant to the
issues in this case and is not reasonably calculated to lead to the discovery of admissible
evidence. Without waiving the foregoing objection , Defendant admits that on September
13, 2015, Shannon Barnett was moved to maintenance. Defendant further states that
Shannon Barnett had been "Assistant Maintenance" from October 20, 2013 thruogh
March 12, 2014, at which time Shannon Barnett transferred back to the production
department as a "Utility/Line Worker."
REQUEST N0.14: Defendant's Topeka, KS, employee Shannon Barnett is a
registered sex offender and convicted felon convicted for raping his pre-teenage daughters.
RESPONSE: Objection. This Request seeks information that is irrelevant to the
issues in this case and is not reasonably calculated to lead to the discovery of admissible
evidence. Accordingly, the Defendant refuses to either admit or deny the allegations
contained in Request No. 14.
REQUEST NO. 15: Defendant's Topeka, KS, shift supervisor, Cherron Keeling, has
been disciplined verbally or non-verbally for failing to follow protocol (and/or his posted
instructions) before calling maintenance.
RESPONSE: Objection. This Request seeks information that is irrelevant to the
issues in this case and is not reasonably calculated to lead to the discovery of admissible
evidence. Accordingly, the Defendant refuses to either admit or deny the allegations
contained in Request No. 15.

REQUEST NO. 16: Defendant's Topeka, KS, office manager, Donna Younger, has the
ability to either initiate a written disciplinary report and/or request to the plant manager for the
same to be issued.
RESPONSE: Denied. The Defendant admits that any employee can report a
perceived safety violation which may lead to disciplinary a~tions. It is denied that Donna
Y onger can initiate any disciplinary action at any time.
REQUEST NO. 17: The dust collector located at the Topeka plant was classified as a
confined space in August 2015.
RESPONSE: Admit in part and deny in part. The Defendant admits that the inside
of the dust collector has always been classified as a confined space and employees are
prohibited from entering inside of the collector or any "confined space." Defendant denies
that the area where employees clean out the dust collector is a confined space and is in fact
an open air area.
REQUEST NO. 18: Defendant's Topeka, KS, plant maintenance employees are not
permitted to enter confined spaces.
RESPONSE: Admitted.
REQUEST NO. 19: The defendant compelled plaintiff to make a workers
compensation claim and report to the hospital at 11 :00 a.m. on August 28, 2015.
RESPONSE: Denied.
REQUEST NO. 20: Production employees at the defendant's Topeka, KS, plant (in

September 2015 to April 2014) [sic] washed the production chemicals (listed in the M.S.D.S.
sheets) on their hands and arms off in the sinks connected to the potable water supply.
RESPONSE: The Defendant admits that it provides potable water for employees to
wash their hands and arms.
REQUEST NO. 21: Defendant's Topeka, KS, maintenance employee Corey Lewis,
during his course of employment with the defendant), has one or more times not responded to
emergency after shift maintenance calls and/or texts to his phone from the plaintiff and/or any
other American Phoenix employee.
RESPONSE: Denied.
REQUEST NO. 22: Defendant's Topeka, KS, employee Shannon Barnett was
employed as a maintenance technician immediately preceding plaintiffs hire.
RESPONSE: Objection. This Request seeks information that is irrelevant to the
issues in this case and is not reasonably calculated to lead to the discovery of admissible
evidence. Without waiving the foregoing objection, Defendant admits that Shannon
Barnett had been "Assistant Maintenance" from October 20, 2013 through March 12,
2014, at which time Shannon Barnett transferred back to the production department as a
"Utility/Line Worker."
REQUEST NO. 23: Defendant's Topeka, KS, plant's former plant manager, Phil
Curtis, and defendant's maintenance manager and LT. employee, Steven Good, barred and/or
prohibited Shannon Barnett (defendant's maintenance employee) from "touching" the production
line computers for LT. related matters and instructed Shannon under threat of disciplinary action
to contact Steve Good for LT. issues.
RESPONSE: Objection. This Request seeks information that is irrelevant to the

issues in this case and seeks private and confidential personnel information about an
employee other than the Plaintiff. Without waiving the foregoing objections, this request is
denied.
REQUEST NO. 24: Defendant's Topeka, KS, maintenance employee Corey Lewis
requested earned P.T.O. for the weekend of August 28, 2015, through August 30, 2015.
RESPONSE: Admit.
REQUEST NO. 25: Defendant terminated plaintiff's employment, allegedly, for
reasons stated in plaintiffs termination papers dated September 1, 2015.
RESPONSE: Admit.
REQUEST NO. 26: Defendant's Topeka, KS, employee/shift supervisor Cherron
Keeling admitted in a written statement dated and signed on September 1, 2015, that the
maintenance call defendant refers to as having occurred on August 29, 2015, at about 9:15 p.m.,
was relating to a computer malfunction and/or an LT. issue.
RESPONSE: Objection. This request assumes that the written statement is correct.
As a maintenance supervisor it was Jocco's responsibility to work with and to resolve the
problem if he could not fix the problem, it or otherwise. The written statement was quickly
written by Plaintiff, and Cherron was asked on the spot to sign what was written.
Accordingly, Defendant denies the underlying assumption of this request. Without waiving
the foregoing objection, Defendant admits that Cherron Kelly signed a written statement
that was prepared by Plaintiff on or about September 1, 2015.
REQUEST NO. 27: On August 29, 2015, C-line was "down" due to an LT. and/or
computer and/or software issue (not an electrical-mechanical issue) that the defendant's
employee and I. T. specialist fixed remotely from a computer out of state.

RESPONSE: Objection. This request infers that as Maintenance Supervisor that
Plaintiff would have had no responsibility in resolving any problem with the C-line, and
Defendant denies this underlying inference. Without waiving the foregoing objection and
in light of the foregoing, Defendant admits that ultimately the issue with the C-line was
resolved by I.T.
REQUEST NO. 28: Defendant's Topeka, KS, employee Corey Lewis and the plaintiff
established our own on-call arrangement to respond to after-hour emergency calls.
RESPONSE: Denied.
REQUEST NO. 29: The defendant alleges one reason for terminating plaintiffs
employment was for the interaction between the plaintiff and office manager (Topeka, KS)
Donna Younger on August 21, 2015, as stated and described in the plaintiffs termination papers
dated 09-01-2016.
RESPONSE: Admit.
REQUEST NO. 30: Defendant's Topeka, KS, maintenance employee knows how to
turn on and off the dust collector located at the Topeka plant.
RESPONSE: Objection. This Request is vague and ambiguous as to who Plaintiff
is referring with the word "employee." Without waiving the foregoing objections, certain
and appropriate employees of the Defendant do know how to turn off and on the dust
collector located at the Topeka plant.
REQUEST NO. 31: Defendant's Topeka, KS, employee Donna Younger, on or around
August 2015, was already taking medication for anxiety attacks.
RESPONSE: Objection. This Request seeks information that is irrelevant to the
issues in this case and requests information regarding private and confidential personnel

and medical issue of an employee other than Plaintiff. Accordingly, the Defendant refuses
to either answer or deny this Request.
REQUEST NO. 32: Defendant's employee Connie Flowers, while in charge of the
Topeka plant, instructed plaintiff and defendant's Topeka, KS, maintenance technician Corey
Lewis to equally share over-time calls.
RESPONSE: Defendant lacks sufficient knowledge or recollection to either admit
or deny this request. Defendant asserts that Connie Flowers may have made such a
statement, but Ms. Flowers does not specifically recall making the statement.
REQUEST NO. 33: Plaintiff and defendant's Topeka, KS, maintenance employee
made an arrangement to work "on-calls" for specific shifts, equally sharing after-hour calls.
RESPONSE: Defendant has no knowledge or information regarding
"arrangements" between maintenance employees regarding after-hour calls. Defendant
admits that maintenance employees of the Topeka, Kansas facility are required to be
available for after-hour calls.
REQUEST NO. 34: Defendant's claim that plaintiff disrespected office manager Donna
Younger pertains to the incident documented by defendant and Donna Younger on August 21,
2015, surrounding the health concern that plaintiff had about another employee and plaintiffs
comments about the ongoing federal investigation against the defendant.
RESPONSE: Admit.
REQUEST NO. 35: Defendant's Topeka, KS, office manager Donna Younger's
leaving work early on August 21, 2015, per the defendant's attendance policy, was an unexcused
absence.

plaintiff agreed that Corey Lewis would work overtime calls the weekend of August 21, 2015 -
August 23, 2015, since he (Corey Lewis) would be out of town on P.T.O. the following weekend
of August 28, 2015 -August 30, 2015.
RESPONSE: Defendant has no knowledge or information regarding
"arrangements" between maintenance employees regarding after-hour calls. Defendant
admits that maintenance employees of the Topeka, Kansas facility are required to be
available for after-hour calls.
REQUEST NO. 36 (2) fmisnumbered/: Defendant's Topeka, KS, plant manager
John Butler witnessed and authorized the agreement outlined in Request No. 36 (above).
RESPONSE: Objection. Defendant lacks sufficient knowledge or. recollection to
either admit or deny whether this was witnessed by John Butler or not, and the same is
therefore denied.
REQUEST NO. 37: At the time of plaintiff's termination, the defendant's Topeka, KS,
plant employees had posted names and phone numbers regarding who to call for emergency
after-hour LT. issues and Steven Good, not plaintiff, was one of those designated persons posted
on the board to call for I.T. emergencies.
RESPONSE: Defendant admits that a list of emergency telephone numbers is
posted, and that it is likely I.T. Steven Good's number was one of those posted. Defendant

REQUEST NO. 39: Defendant's pre-weigh manager Jeff Menard asked defendant's
Topeka, KS, maintenance technician (plaintiffs subordinate) Corey Lewis "to make fixing the
dust collector a priority."

told Jeff Menard (AP.I. pre-weigh manager) "the dust collector was not purging because the

an EEOC racial discrimination complaint, yet still asked plaintiff on or around August 14, 2015

confidentiality agreement prohibiting plaintiff from discussing any internal matter with anyone
not authorized by the defendant.

REQUEST NO. 55: Defendant's Topeka, KS office manager, on or around July 2015,
hit A.P .I. employee Mark Webster in the face with a $5 dollar bill in front of John Butler and
was not issued any disciplinary reprimand.
RESPONSE: Denied.
REQUEST NO. 56: The extent of plaintiffs workers compensation request to the
defendant was where could plaintiff go to be tested to see if chemicals are (were) in my system
and if the defendant will pay for it.
RESPONSE: Denied.
REQUEST NO. 57: Plaintiffs workers compensation claim was for "accumulative
exposure" to chemicals, not an on-the-job accidental injury.
RESPONSE: Defendant denies Plaintiff made a worker's compensation claim. By
way of further response, Defendant admits that the Plaintiff claimed "accumulative
exposure" to chemicals. The Defendant asserts that if there had been any illness or injury
resulting from exposure to chemicals by Plaintiff while working for the Defendant then the

REQUEST NO. 58: Defendant, during correspondence with Dr. Dale Garrett, revealed
to Dr. Garrett on 8.28.1 (from Stormont-Vail workcare) that plaintiff was "nearly termed
[terminated] ]for filing] internal discrimination claim EEOC Chrg. [charge] now work comp. He
[plaintiff] called OSHA & KDHE."
RESPONSE: The Defendant admits that it told Dr. Garrett, upon request for
information from Dr. Garrett for the purpose of providing medical treatment, that Plaintiff
was nearly terminated and subsequently filed an internal discrimination claim, an EEOC
charge and now a Workers Compensation claim. All other allegations contained in
Request No. 58 are denied.
REQUEST NO. 59: Defendant admits paragraphs No. 2-5 in plaintiff's complaint filed
04-25-2016.
RESPONSE: Admit.
REQUEST NO. 60: On or about August 25, 2015, plaintiff, concerned for his health
and wellbeing, made a report of defendant's suspected safety and health violations regarding the
exposure to toxic chemicals and the handling of and disposal of those chemicals to three
agencies: Kansas Department of Labor, Kansas Department of Health and Environment, and
U.S. Occupational Safety and Health Administration.
RESPONSE: Objection. This Request seeks information that the Defendant does
not have, and the Defendant is therefore unable to specifically admit or deny the allegations

admit that toward the end of August, 2015, Plaintiff advised Defendant employees that he

(6 sic) Toxicology Lab Doctor (2:08p.m.) and (3) OSHA area Director J. Freeman ••. all
three advised me that I have the right to request through API workers compensation rights
that the company set up and pay for toxicology tests to be tested for all of the chemicals
that I believe I have been illegally exposed to by the company failing to provide appropriate
measures when I clean out the dust collectors."

employJ!lent related questions. Your loud outbursts and intimidating behavior brought
the Office Manager to tears. This behavior cannot be tolerated in any workplace, which
is one re~scm why API carries so· many policies to combat the very inappropriate actions
you directed toward the Office Manager.
Job Petformance Issues
On or about, August 4, 2015, Plant Manager Jeff Menard had a verbal discussion with
you regarding poor job performance. There were several issues discussed including the
dust collector not working properly. The week prior you had told Jeff that it was working
properly, however it still wasn't working as of August 3, 2015, at which time t_he repair
was reassigned to the day-shift mechanic."

About 6:451_ came into work. Didn't even Clock _In yet. A new temp (G\,vyndell) walked up to me and asked if I could
enroll his hand tntothe AS~ystem-theycould not get it to work last.night. I enrolled hiS hand and asked him to go into
my offic~ so 1 c:cmld give him orientation. lhen I hoticed he was rubbing his eye and toid him not to rub It and to go
wash It .out. He came back and sat d~wn~ Jocco opened my- doora~d as_ked "what paperwork do we fill out for
incidents" i tofd him "We fitl.outari accjdent report; take einploye~: to er and have a UA done". Jocco said "That is
· intimidation; th~ Fec:fs ai:e gonn~Jove thi~" I walked into Johns offic~ and got an inddent package. Jocco kept going on .
about the Feds. and ~~id "twish thls\va!; being recorded" I said "It_ is being recorded and I did not wantto talk about
this".- he:lsaid:;,no, voite n~corded, Feels are going to love this": I w~lked hitothe office and started filling out the
paperwork. I could hear him outside my door talking about Feds Investigation. t ·stepped back out to see what was going
on, there was probably about 10 people gathered ar.ound. I went b~ck iri and tried to tend to Gwyndell (adding eye
drops and making sure h~_dld not ~ub his eye). John came in theck~d on us. About 7:00 am I remembered to clock in.
Within tirrie l ggt through orientation and other items and around 8':10 am I had to leave work-to get away. It was
gettl~g-tome emotlonall'(. On the way home I calledUridaand told herthe situation. I plan on going back to work
-around 10:00 am after Joccos shift Is over. . . -
