N.D. Peters & Co., Inc. (3-CA-20211; 327 NLRB No. 167) Utica, NY March 19, 1999. The administrative law judge found, and the Board agreed, that the Respondent violated Section 8(a)(1), (3), (5) of the Act by failing and refusing to recall from layoff its employee Charles Piccione; and violated Section 8(a)(1) and (5) by failing to abide by the seniority provisions in its expired collective-bargaining agreement, and by not affording the Union with an opportunity to bargain on that issue.
