Aid and Abet

People v Robinson,475 Mich 1 (2006)(may'06). In this case an aggravated assault was committed by defendant and a co-defendant. Defendant and co-defendant went to "fuck up" the victim. At one point in the beating defendant told co-defendant "that's enough" and left. After leaving defendant heard a gun shot. The co-defendant was convicted of murder 1. Defendant was convicted of murder 2 under an aiding and abetting theory. The court of appeals reversed, holding that defendant did not share in or know of the co-defendant's intent to kill.
