In Hyster Company v. N.L.R.B., 480 F.2d 1081 (5th Cir. 1973), a panel of this court would not place such a burden on the company where "[t]here was no definite evidence that [the chairman of the Town Council] was overtly clothed with apparent authority to act for the company, or that the company knew of the content of his conversations with employees, such as to place a duty of disavowal on the company."
