Section 3701.12 - Third party payment for department goods and services(A) As used in this section: (1) "Third party" means any person or government entity other than the department of health or a program administered by the department.(2) "Third party benefits" means any and all benefits paid by a third party to or on behalf of an individual or the individual's parent or guardian for goods or services the individual has received from the department of health or a grantee or contractor of the department.(B) Except as provided in division (C) of this section, the department of health shall not, on or after January 1, 2018, pay for goods or services that are payable through third party benefits.(C) The prohibition in division (B) of this section does not apply when expressly contrary to another provision of the Revised Code or when, as determined by the director of health, department of health funds are required to mitigate the spread of infectious disease or are needed for exceptional circumstances.Added by 132nd General Assembly File No. TBD, HB 49,§101.01, eff. 9/29/2017.
