Section 19:44A-20.25 - Inapplicability of act under federal law or eminent domain

The provisions of sections 1 through 12 of this act, P.L. 2005, c. 51, shall not:

a. apply in circumstances when it is determined by the federal government or a court of competent jurisdiction that its application would violate federal law or regulation; or
b. prevent the State, its executive departments, agencies or independent authorities from complying with all of the requirements, conditions and obligations of the "Eminent Domain Act of 1971," P.L. 1971,
c.361 (C.20:3-1 et seq.), as amended and supplemented.

L. 2005, c. 51, s. 18, states: "Sections 14, 15 and 16 shall take effect on the original effective date of P.L. 2004, c 19 (C. 19:44A-20.2 et seq.), and the remainder of this act shall take effect immediately and shall be retroactive to October 15, 2004 and shall apply to contributions made and contracts awarded on or after October 15, 2004." .
