§ 1001. Who are merchants

The following are merchants for the purposes of this code:

(1) Those who, having legal capacity to engage in business, regularly devote themselves thereto, in their own name.

(2) Commercial or industrial companies, corporations and associations organized in accordance with this Code or with special laws, and corporations and companies organized abroad, also for commercial and industrial purposes, and duly authorized to do business in Puerto Rico.
