Section 7:1J-9.1 - Convening a board of arbitration
(a) The administrator shall convene a board of arbitration upon the occurrence of any of the following:
1. When a claimant contests in writing the denial of a claim issued by the administrator pursuant to 7:1J-6.6(e), and requests arbitration pursuant to 7:1J-6.6(g); provided, however, that arbitration of denial of a claim shall be granted only if the denial was based solely upon the lack of validity of the claim;
2. When a claimant rejects a settlement offer made by the administrator pursuant to 7:1J-8.4(c);
3. When any potentially responsible party contests the validity or amount of the claim under 7:1J-8.2(a), the administrator contests the validity or amount of the claim under 7:1J-8.2(b), or any other person contests the validity or amount of the claim under 7:1J-8.2(c); or
4. When a claimant has failed to agree upon a settlement with a potentially responsible party within the time allotted pursuant to 7:1J-7.2, and the administrator has elected not to make a settlement offer pursuant to 7:1J-8.3(a).
(b) The administrator shall deny a request for arbitration if the requesting party fails to submit all of the information required under 7:1J-8.2, within the time allotted under that section.
