IN PROHIBITION.

The relator, Thomas W. Maxson, city solicitor of the city of Grandview Heights, instituted this action in prohibition in this court to prevent the respondent, the Board of County Commissioners of Franklin County, from issuing an order to its clerk to forward to the auditor or clerk of the city of Columbus the final transcript for the annexation of 910 acres in Franklin Township to the city of Columbus.

The pleadings and stipulation of facts disclose that on September 4, 1956, a petition was filed with the board to annex 426 acres in Franklin Township to the city of Grandview Heights. The petition contained the signitures of a majority of the freeholders residing in the territory sought to be annexed.

On September 21, 1956, a petition was filed with the board to annex 910 acres in Franklin Township to the city of Columbus. The petition contained the signitures of a majority of the freeholders residing in the territory sought to be annexed, which territory included the 426 acres sought to be annexed to Grandview Heights.

On December 18, 1956, a hearing was had before the board, and a majority of the members voted that the prayer of the petition for annexation of the 426 acres to Grandview Heights be granted. On December 27, all the original papers and transcript of proceedings were certified and delivered to the clerk of Grandview Heights.

An application for rehearing and motion to reconsider the petition to annex to Grandview Heights, filed on January 14, 1957, was granted on January 29. On February 5, pursuant to the resolution of January 29, the board, over objection that it was without authority to rehear or reconsider the petition, proceeded with the hearing, heard new evidence on the subject of ability of Grandview Heights to service the area, rescinded the order allowing such annexation and set March 25 as the date for the rehearing.

On February 26, the council of Grandview Heights adopted an ordinance accepting the application for annexation of the 426 acres, and on the same day the clerk of council delivered to the county recorder and to the Secretary of State a transcript of the annexation proceedings.

On March 25, the board, pursuant to its resolution of February 5, held a hearing, dismissed the petition for annexation to Grandview Heights, held a continued hearing on the petition to annex the 910 acres to the city of Columbus and ordered that the 910 acres be so annexed.

On March 29, the instant action in prohibition was instituted.

An amended answer was filed by the board, to which relator filed a reply. The case is presented on the pleadings, stipulation of facts, briefs and oral argument.

The basic of this action is the alleged previous annexation to Grandview Heights of the 426 acres included in the 910 acres sought to be annexed to the city of Columbus. Relator contends that the question of annexation to Grandview Heights has become moot; that the board is trying to exercise jurisdiction over territory already annexed to Grandview Heights by including it in territory sought to be annexed to Columbus; that the deposit of the transcript with the clerk of Grandview Heights terminated the jurisdiction of the board over the 426 acres; that the board is without authority to rehear or redetermine a matter upon which it has finally acted; and that the attempted exercise of jurisdiction by rescinding is null and void.

The basic issue to be determined is whether the board had jurisdiction to grant the application for rehearing or reconsideration of the Grandview Heights annexation petition and to reconsider the same. This court is of the opinion that it did.

In State, ex rel., v. Board of Public Service of Columbus, 81 Ohio St. 218, 90 N.E. 389, it was held that the respondent board there, after passing a resolution determining to award a contract to one who was found to be the lowest and best bidder and ordering that a contract be entered into with him, could lawfully rescind such action and refuse to notify such bidder and enter into a contract with him. In the opinion it is stated:

"That rule, well settled by numerous adjudications, is to the effect that the action of such bodies respecting legislative or administrative matters is not always conclusive and beyond recall, but that they are possessed of inherent power to reconsider their action in matters of that nature, and adopt if need be the opposite course in all cases where no vested right of others has intervened, the power to thus act being a continuing power."

In National Tube Co. v. Ayres, Aud., 152 Ohio St. 255, 262, 89 N.E.2d 129, the authority of the Board of Tax Appeals to entertain a motion for rehearing and set aside its decision was questioned. It is stated in the opinion that "it has been a long established precedent in this state that boards such as the Board of Tax Appeals have control over their decisions until the actual institution of an appeal or the expiration of the time for appeal."

The holding in State, ex rel. Griffey, v. Industrial Commission, 125 Ohio St. 27, 180 N.E. 376, that the continuing jurisdiction of the Industrial Commission applies only to new and changed conditions occurring after the original award, is based on an interpretation of a statute applying only to the Industrial Commission. See, also, State v. Ohio Stove Co., 154 Ohio St. 27, 93 N.E.2d 291.

In the instant case, the board had the statutory power and duty to determine, in the exercise of its sound discretion, whether annexation to Grandview Heights should be granted and had continuing jurisdiction to reconsider its decision until the institution of court proceedings attacking such decision or until the expiration of the time allowed for the institution of such proceedings (Section 709.04, Revised Code).

The board, having denied the petition for annexation of the 426 acres to Grandview Heights, had the jurisdiction to grant the prayer of the petition for annexation of that acreage to Columbus. The correctness or reasonableness of its decision is not before this court.

The writ of prohibition is denied.

This case serves to point up the need for further legislative consideration of the problems presented by the constantly increasing volume of annexation programs.

Here, the Board of County Commissioners rendered its decision on December 18, 1956, and on December 27 certified and delivered the original papers and transcript of proceedings to the clerk of Grandview Heights. The distinction between the facts here and in the case of State, ex rel., v. Board of Public Service of Columbus, 81 Ohio St. 218, 90 N.E. 389, relied upon in the per curiam opinion, lies in the second paragraph of the syllabus thereof, which states:

"2. Where, after proper advertisement for bids, and bids have been received, a resolution has been duly adopted by such board finding a bidder therein named to be the lowest and best bidder and directing the clerk to notify the bidder of that fact, but before such notice has been given the resolution is, for reasons by the board deemed sufficient, rescinded and an order made to again advertise for bids, the bid of such bidder being thereby rejected, such rescission and an order will not be treated as an abuse of discretion * * *." (Emphasis added.)

In the instant case, the Board of County Commissioners of Franklin County had completed its part of the transaction, if it may be called that, when it certified and delivered the transcript to the city of Grandview Heights.

As stated in the per curiam opinion, the correctness or reasonableness of the board's decision is not before this court. In the interval between the granting of the petition for annexation to Grandview Heights followed by the certification and delivery of the original papers and the transcript of proceedings and the so-called granting of application for rehearing and motion to reconsider on January 29, there was a change of membership of the board, one member having died and his successor having been qualified. It is reasonable to assume, therefore, that, but for this change of membership, there would have been no reversal of the board's position. In this minority view, such action should not be validated unless clearly authorized by statute.

The cases of State, ex rel. Griffey, v. Industrial Commission, 125 Ohio St. 27, 180 N.E. 376, and National Tube Co. v. Ayres, Aud., 152 Ohio St. 255, 89 N.E.2d 129, cited in the per curiam opinion are not persuasive in the writer's judgment for several reasons. Paragraph one of the syllabus in the Griffey case states:

"1. The continuing jurisdiction of the Industrial Commission, under authority of Section 1465-86, General Code, applies only to new and changed conditions occurring after an original award."

That situation did not obtain here. Also, both cases involved decisions of agencies which are quasi-judicial in nature, whereas, a Board of County Commissioners is basically legislative and administrative.

Section 709.07, Revised Code, provides for an attack through the courts on a proposed annexation prior to municipal acceptance rather than for a reconsideration period for a board. If we cannot assume this as the legislative intent, then all that a board would have to do in order to keep all parties concerned in a state of indecision indefinitely would be to revoke a decision respecting an annexation approval on the 59th day thereafter and grant reconsideration.

Terminal points are always desirable in the administration of public business, but it is submitted that the effect of the decision here does not help to accomplish finality in the successive steps in annexation proceedings.

Without attempting to pass upon the discretion or wisdom of the board in its actions here, we believe it is a safer rule to consider transmission of a certified transcript of annexation approval to a municipality to be the final act of a Board of County Commissioners unless the Legislature specifically provides for a reconsideration period. Until further legislation, the decision in this case will at least clarify the law of this state with respect to the power of a Board of County Commissioners to reconsider its approval of an annexation application right up until the point of acceptance by the city council of the municipality concerned.
