DISPOSITION
Colten Marbry ("Plaintiff") filed a pro se Complaint pursuant to 42 U.S.C. § 1983. (Doc. No. 2). At the time Plaintiff filed this lawsuit, he was incarcerated in the Mississippi County Detention Center. (Id.) On December 28, 2020, mail from the Court to Plaintiff was returned as undeliverable with the notation "Return To Sender No Longer At This Facility" on the envelope. (Doc. No. 19.) On December 29, 2020, I directed Plaintiff to update his address within thirty (30) days, as required by Local Rule 5.5 (Doc. No. 20.). (See also Doc. No. 5 at 3, advising Plaintiff of his duties under Local Rule 5.5(c)(2).) Plaintiff was warned that if he did not do so, his case may be dismissed without prejudice. (Id.) Plaintiff has not updated his address with the Court, and Mail from the Court to Plaintiff continues to be returned as undeliverable. (Doc. Nos. 21-23.)
IT IS, THEREFORE, RECOMMENDED that:
1. Plaintiff's Complaint (Doc. No. 2) be DISMISSED without prejudice.
2. The Court certify, pursuant to 28 U.S.C. § 1915(a)(3), that an in forma pauperis appeal from any Order adopting this recommendation and the accompanying Judgment would not be taken in good faith.
