          WASTE, Chief Justice.

         The order heretofore made, pursuant to oral stipulation of counsel, and motion whereby it was ordered that the decision herein of the District Court of Appeal, Second Appellate District, Division 1 (59 P.2d 547) be adopted as the decision of this court and that remittitur issue forthwith, is hereby vacated and set aside. The remittitur issued heretofore, pursuant to said stipulation and order, is hereby recalled, and the cause is hereby resubmitted as of this date.
