Charles E. Holster III brought a putative class action in the United States District Court for the Eastern District of New York (Bianco, J.) alleging violations of the Telephone Consumer Protection Act ("TCPA"), 47 U.S.C § 227(b)(1)(C). Federal jurisdiction was grounded on diversity of citizenship. See 28 U.S.C. § 1332(d)(2). The District Court dismissed the complaint. See Holster v. Gatco, Inc., 485 F. Supp. 2d 179, 180 (E.D.N.Y. 2007). We affirm. See Bonime v. Avaya, Inc., 07-1136-cv, ___ F. 3d ___ (2d Cir. 2008). The judgment of the District Court is AFFIRMED.
