In 1974, Congress enacted the Energy Reorganization Act, pursuant to which it abolished the Atomic Energy Commission and divided its functions between the Energy Research and Development Agency and what is now the Nuclear Regulatory Commission. See 42 U.S.C. § 5801 et seq. In 1977, pursuant to the Department of Energy Organization Act, the Department of Energy assumed the responsibilities of the then-abolished Energy Research Development Agency.
