Section 725 ILCS 5/110-14 - Credit toward fines for pretrial incarceration
(a) Any person denied pretrial release and against whom a fine is levied on conviction of the offense shall be automatically credited $30 for each day so incarcerated upon application of the defendant. However, in no case shall the amount so credited exceed the amount of the fine.
(b) Subsection (a) does not apply to a person incarcerated for sexual assault as defined in paragraph (1) of subsection (a) of Section 5-9-1.7 of the Unified Code of Corrections.
(c) A person subject to bail on a Category B offense, before January 1, 2023, shall have $30 deducted from his or her 10% cash bond amount every day the person is incarcerated. The sheriff shall calculate and apply this $30 per day reduction and send notice to the circuit clerk if a defendant's 10% cash bond amount is reduced to $0, at which point the defendant shall be released upon his or her own recognizance.
(d) The court may deny the incarceration credit in subsection (c) of this Section if the person has failed to appear as required before the court and is incarcerated based on a warrant for failure to appear on the same original criminal offense.

Continuation of provisions; validation: P.A. 102-0687,§ 240 provides:

(a) The General Assembly finds and declares that Public Act 102-28 and this Act manifest the intention of the General Assembly to have Section 1-2-12.1 of the Illinois Municipal Code and Sections 110-5.1, 110-6.3, 110-6.5, 110-7, 110-8, 110-9, 110-13, 110-14, 110-15, 110-16, 110-17, and 110-18 of the Code of Criminal Procedure of 1963 continue in effect until January 1, 2023.

(b) Section 1-2-12.1 of the Illinois Municipal Code and Sections 110-5.1, 110-6.3, 110-6.5, 110-7, 110-8, 110-9, 110-13, 110-14, 110-15, 110-16, 110-17, and 110-18 of the Code of Criminal Procedure of 1963 are deemed to have been in continuous effect and shall continue to be in effect until January 1, 2023. All actions taken in reliance on or under Section 1-2-12.1 of the Illinois Municipal Code and Sections 110-5.1, 110-6.3, 110-6.5, 110-7, 110-8, 110-9, 110-13, 110-14, 110-15, 110-16, 110-17, and 110-18 of the Code of Criminal Procedure of 1963 by any person or entity before the effective date of this Act are hereby validated.

(c) To ensure the continuing effectiveness of Section 1-2-12.1 of the Illinois Municipal Code and Sections 110-5.1, 110-6.3, 110-6.5, 110-7, 110-8, 110-9, 110-13, 110-14, 110-15, 110-16, 110-17, and 110-18 of the Code of Criminal Procedure of 1963, those Sections are set forth in full and reenacted by this Act. Striking and underscoring are used only to show changes being made to the base text. This reenactment is intended as a continuation of this Act. This reenactment is not intended to supersede any amendment to this Act that may be made by any other Public Act of the 102nd General Assembly."
