Indeed, under California law, it may be that no adverse inference could be drawn from Kurniawan’s invocation of his Fifth Amendment privilege at trial. See Cal. Evid. Code § 813. And the California court presiding over the California Action has not ruled whether Kurniawan’s arrest or the criminal charges against him will be admissible in the California Action.
