Hearsay evidenceis said to be “unreliable” because the statement might be distorted or misinterpreted by the witnessrelating it in court, the hearsay statement is not made under oath, the person who made the statement cannot be observed by the judge or jury to evaluate his/her credibility and the adverse party has not had the 33 opportunity to cross-examine the person who made them.
