Section 7:14B-5.1 - Spill and overfill control(a) The owner and operator shall ensure the following: 1. There shall be no release of hazardous substance at an underground storage tank facility;2. The available volume in an underground storage tank shall always be greater than the volume of hazardous substance being transferred to the tank; and3. The transfer operation is monitored constantly to avoid spilling and overfilling.(b) The transfer procedures described in National Fire Protection Association Standard 385, "Standard for Tank Vehicles for Flammable and Combustible Liquids" (available at www.nfpa.org), and American Petroleum Institute Recommended Practice 1007, "Loading and Unloading of MC 306/DOT 406 Cargo Tank Motor Vehicles" (available at www.api.org), incorporated herein by reference, as amended and supplemented, shall be used to comply with (a) above. Further guidance on spill and overfill prevention appears in American Petroleum Institute Recommended Practice 1621, "Bulk Liquid Stock Control at Retail Outlets".(c) The owner and operator shall report, investigate, and remediate any discharge from the underground storage tank system in accordance with the Administrative Requirements for the Remediation of Contaminated Sites, N.J.A.C. 7:26C.N.J. Admin. Code § 7:14B-5.1
