ORDER GRANTING GOVERNMENT'S MOTION FOR LEAVE TO FILE INSTANTER ITS RESPONSE TO DEFENDANT'S MOTION TO DISMISS COUNT THREE


On 22 February 2002, Defendant Detore filed a motion to dismiss Count 3 of the superseding indictment. (Docket # 203). On 6 March 2002, the Government moved for an additional thirty days to respond to the motion. (Docket # 222). This Court granted the motion for a thirty day extension. On 19 April 2002, Defendant Detore filed a motion for an entry of dismissal in light of the fact that the government had not responded to the initial motion to dismiss Count 3. (Docket # 345). The government then moved for leave to file instanter its response. (Docket # 346).

Defendant Detore does not oppose the government's motion for leave to file instanter. The government's motion is granted and the government's response wilt be considered by the Court.
