Leroy Dwayne Turner appeals his conviction, in a jury trial, for criminal nonsupport. Punishment was assessed at two years' confinement in a state jail facility and a fine of $10,000, probated for five years. The reporter's record in this case consists of two hearings wherein the trial court determined appellant was not an indigent. On April 19, 2010, the Court received notice from the court reporter that appellant had not made arrangements to pay for the reporter's record of his trial. On September 24, 2010, the Court abated this appeal and ordered the trial court to conduct a hearing to determine why appellant had not filed his brief. During the hearing, the trial court orally found appellant is not indigent, he has failed to communicate with appointed counsel, he has not complied with the conditions of his appeal bond, he has absconded, and he has abandoned his appeal. We adopted the trial court's findings and ordered the appeal submitted on the reporter's record as filed, without briefs. See Tex. R. App. P. 38.8(b)(4). Without briefs, no issues are before us. Finding no fundamental error, we affirm the trial court's judgment.
