Upon consideration of the Petition for Contempt and Order to Show Cause, the responses thereto, and the Motion for Entry of Consent Judgment, it is ordered that the petition is denied as moot and this Court's order to show cause dated December 7, 2006, is discharged, and the motion for entry of consent judgment is granted. The conditions of the probation imposed in Florida Bar v. Gutierrez, 884 So. 2d 25 (Fla. 2004) are amended to require respondent to submit a passing score on the ethics portion of the Bar examination, and to complete the remaining 177 hours of community service prior to him petitioning for reinstatement.
