STATE OF LOUISIANA IN THE INTEREST OF D.B.

In Re: State of Louisiana, applying for supervisory

writs, Juvenile Court, Parish of East Baton

Rouge, No. 00430.
BEFORE: PARRO, WELCH, AND KLINE, JJ.

Kline, J., serving as Judge pro tempore of the Court of Appeal, First Circuit, by special appointment of the Louisiana Supreme Court.

WRIT GRANTED. STAY LIFTED. The trial court's ruling granting the juvenile's motion for release is reversed. Good cause exists for the juvenile court to extend the period for the adjudication hearing and for the juvenile to remain in custody. The State filed the motion to transfer the juvenile's case to the district court within the sixty-day time limit set forth in La. Ch. Code art. 877(A). See La. Ch. Code art. 877(D). The stay previously issued by this Court in this matter is hereby lifted.

JEW

Kline, J. would maintain the stay, and prior to considering the merits, would order the juvenile court to file a per curiam addressing the application of La. Ch. Code art. 877(D), which provides that for good cause, the juvenile court may extend the time period for holding the adjudication hearing. COURT OF APPEAL, FIRST CIRCUIT
