CONFIDENTIAL

An appeal having been taken to this Court from the order of the Family Court, Bronx County, entered on or about May 28, 2019, and said appeal having been perfected, And petitioner-appellant having moved for a stay of all proceedings in Family Court pending hearing and determination of the aforesaid appeal (M-173), And respondent-respondent having cross-moved for leave to respond to the aforesaid appeal as a poor person, and for assignment of counsel, a free copy of the transcript, and for related relief (M-299), Now, upon reading and filing the papers with respect to the motion and cross motion, and due deliberation having been had thereon, It is ordered that the motion for a stay (M-173) is denied. The cross motion for poor person relief (M-299) is denied, with leave to renew upon respondent-respondent's submission of a detailed notarized affidavit, pursuant to CPLR 1101(a) and 22 NYCRR 1250.4(d)(1), setting forth, inter alia, facts sufficient to establish that respondent-respondent has no funds or assets with which to respond to the appeal, including the amount and sources of all income and list of all property with its value. Sua sponte the perfected appeal is adjourned to the June 2020 Term.
