Cronic’s presumption ofprejudice is “the exception, not the rule.” (Scarpa v. Dubois (1st Cir. 1994) 38 F.3d 1, 12.) It applies only to the most expansive forms of interference with counsel’s performance that amount to a constructive denial of counsel altogether.
