MEMORANDUM OF DECISION ON FATHER'S MOTION TO MODIFY CHILD SUPPORT ORDER (#125)

On December 15, 2005, this court issued a memorandum of decision on a motion of the defendant to modify child support. The findings and orders with regard to the amount of child support contain a scrivener's error. The court had intended to find that the presumptive support amount is for the defendant to pay $110 per week in current support, as shown by the child support guidelines worksheet appended to the decision. Based on defendant's stipulation that he was then four weeks behind in child support, he owed an arrearage then of an additional $440. Assuming that since then he has paid the amount set forth in that decision, he also owes an arrearage for the difference since then between the correct support amount of $110 per week and $86, the amount incorrectly stated in the court's December 15th decision. This results in an additional arrearage in the amount of $96, for a total arrearage of $536. (He should, however, also receive credit for any payments he has made toward the arrearage since that decision.) He shall pay child support by wage withhold in the amount of $110 per week for current child support, plus $22 per week towards his arrearage.

In all other respects, the December 15, 2005, Memorandum of Decision shall remain as previously rendered, the court having considered all of the evidence and the applicable statutory provisions.
