Argued May 14, 1958
Decided June 25, 1958
Appeal from the Appellate Division of the Supreme Court in the second judicial department, ANTHONY E. MAGLIO, M.
Peter Campbell Brown, Corporation Counsel ( Fred Iscol and Seymour B. Quel of counsel), for appellant.
Paul Maddaus, respondent in person.
Order affirmed. We agree with the Appellate Division that the evidence presented at the trial fails to establish that the defendant committed the offense charged against him; by his conduct, he did not "interfere with or obstruct" an inspector, within the meaning of section 186 of the Sanitary Code of New York City. No opinion.
Concur: Chief Judge CONWAY and Judges DESMOND, DYE, FULD, FROESSEL, VAN VOORHIS and BURKE.
