Judgment unanimously affirmed, with costs. In affirming the judgment we note the concession of counsel that the defendant shall not be liable under the separation agreement for any amounts accruing after February 21, 1944. Accordingly, the judgment in the action shall be deemed to have the effect of determining the defendant's liability to the plaintiff in accordance with the stipulation.
