STIPULATION AND [PROPOSED] ORDER RE-NOTING PLAINTIFF'S MOTION FOR PRELIMINARY INJUNCTION AND REVISING BRIEFING SCHEDULE


I. STIPULATION

The parties, through their undersigned counsel of record, jointly request and stipulate to the entry of the subjoined order revising the noting date and briefing schedule on Plaintiff's Motion for Preliminary Injunction (the "Motion"). Pursuant to the Court's prior Order dated January 9. 2003, the Motion is noted for January 31, 2003, Defendant's opposition papers are due January 21, 2003 and Plaintiff's reply papers are due January 28, 2003. The parties request an order extending this schedule for one week. With this extension, Defendant's opposition papers will be due Monday, January 27, 2003, Plaintiff's reply papers will be due Tuesday, February 4, 2003, and the motion will be re-noted to Friday, February 7, 2003. The parties are seeking this extension of time to facilitate ongoing negotiations over a settlement agreement.

II. ORDER

This matter having come before the Court on the joint request and stipulation of the parties, and good cause having been shown,

IT IS HEREBY ORDERED THAT Plaintiff's Motion for Preliminary Injunction shall be re-noted to Friday, February 7, 2003. Defendant's opposition papers will be due Monday, January 27 2003, and Plaintiff's reply papers will be due Tuesday, February 4, 2003.
