Case No. 2:03-CV-34 TC. (D. Utah Sep. 29, 2004)

Case No. 2:03-CV-34 TC.

ORDER

In response to the Defendants' four motions for partial summary judgment, Plaintiff Michael Monahan filed a Motion for a Rule 56(f) Continuance. Since then, Plaintiff has been granted leave by United States Magistrate Judge Samuel Alba to take the depositions of Julene Persinger, Wendi Miller, and Thomas Loveridge. The information to be gathered during these depositions may have some relevance to at least a portion of the Defendants' motions for partial summary judgment. Rather than consider Defendants' motions in a piecemeal fashion, the court has decided to grant Plaintiff's request for a continuance with respect to all of the Defendants' motions. Accordingly, the court ORDERS as follows:

1. Plaintiff's Motion for a Rule 56(f) Continuance is GRANTED.

2. The hearing on Defendants' four motions for partial summary judgment, currently scheduled for Thursday, October 14, 2004, at 3:30 p.m., is stricken.

3. Plaintiff shall file supplemental opposition memoranda to Defendants' motions for partial summary judgment no later than Wednesday, December 1, 2004. Defendants may file reply memoranda to Plaintiff's supplemental opposition briefs no later than fifteen days after service of Plaintiff's supplemental opposition briefs.

4. A hearing on the Defendants' four motions for partial summary judgment (Docket Nos. 70, 74, 76, and 78) is re-scheduled for Monday, January 31, 2005, at 3:00 p.m.

IT IS SO ORDERED.
