Mar Investors Corp. v. Cerda

Appellate Division of the Supreme Court of New York, First Department
Oct 4, 1994
208 A.D.2d 355 (N.Y. App. Div. 1994)

Opinion

October 4, 1994

Appeal from the Supreme Court, Bronx County (Anita Florio, J.).

In light of the deference afforded to fact finders, such as the Referee in this case, and in light of the documentary and testimonial evidence, the award of damages to plaintiff was well founded (see, Claridge Gardens v. Menotti, 160 A.D.2d 544, 545).

Concur — Murphy, P.J., Ellerin, Ross, Nardelli and Williams, JJ.
