ORDER


Before the court are the Findings, Conclusions and Recommendation of the United States Magistrate Judge ("Report"), filed July 6, 2004, to which no objections have been made. After reviewing the findings and conclusions, the court determines them to be correct, and they are accepted as those of the court. Accordingly, for the reasons stated by the magistrate judge in her Report, Defendant's Motion for Summary Judgment, filed April 5, 2004, is granted, and this action is hereby dismissed with prejudice. The court will issue judgment by separate document pursuant to Fed.R.Civ.P. 58. It is so ordered.
