Original Proceeding on Petition for Writ of Mandamus

MEMORANDUM OPINION

Relator, Rosa A. Mungia, has filed a petition for writ of mandamus to vacate the trial court's order that excluded relator's evidence.

The underlying case is Rosa A. Munguia, as Next Friend of Ermelinda Saray Ucles and Jose Moises Ucles, Minors, cause number 2014-73021, pending in the 190th District Court of Harris County, Texas, the Honorable Patricia J. Kerrigan presiding.

Because relator has an adequate remedy by appeal, we deny the petition for writ of mandamus. See TEX. R. APP. P. 52.8. We further deny relator's alternative request to treat the mandamus petition as a permissive appeal because the trial court never granted permission to appeal. See TEX. CIV. PRAC. & REM. CODE ANN. § 51.014(d) (West Supp. 2016); TEX. R. APP. P. 28.3(a).
