IN RE BROOKLYN SWEEPS, INCORPORATED AND KAYLA ADAMS, Relators

ORIGINAL PROCEEDING WRIT OF MANDAMUS
80th District Court Harris County
, Texas
Trial Court Cause No. 2018-45577A

ORDER

On November 19, 2018, relators Brooklyn Sweeps, Incorporated and Kayla Adams filed a petition for writ of mandamus in this court. Relators ask this court to order the Honorable Larry Weiman, Judge of the 80th District Court, in Harris County, Texas, to rule on relators' Motion to Dissolve Writ of Garnishment (the "Motion"). On relators' motion, this court ordered "further proceedings under the writ of garnishment STAYED until a final decision by this court on relators' petition for writ of mandamus, or until further order of this court."

On November 30, 2018, J & J Equipment, LLC, the real party-in-interest, filed a response stating, "Yesterday, on November 29, 2018, Judge Hanen [of the federal court to which the main case was removed] remanded the main case back to the 80th District Court. Judge Weiman is now free to rule on the motion to dissolve."

We modify our stay to provide that Judge Weiman may proceed to rule on relators' Motion.

We request counsel for relators to notify this court as to whether Judge Weiman rules or fails to rule on the Motion within ten days after relators have notified Judge Weiman of the remand of the main case and requested a ruling on the Motion.

PER CURIAM Panel consists of Justices Busby, Brown, and Wise.
