MEMORANDUM OF DECISION de DEFENDANT'S MOTION FOR MODIFICATION POSTJUDGMENT (190)


HARRIGAN, J.T.R.

This motion, dated April 17, 2009, alleges that since the date of judgment, May 28, 2008, the defendant's assets and income have been substantially reduced. He also seeks to have the life insurance coverage of $2,500,000 reduced.

Judgment was rendered on May 28, 2008. In the court's memorandum it made the following finding:

The court concludes the defendant's net weekly income, based on all the credible evidence, exceeds $3,500.

His current affidavit filed July 16, 2009 lists:

Total Net Weekly Income $3,444.45.

The court finds no substantial change in the defendant's net income. The defendant completed the sale of a commercial building located in Illinois subsequent to the dissolution. Liquidating a parcel of real estate does not create a substantial change in circumstances, Simms v. Simms, 25 Conn.App. 231, 593 A.2d 161 (cert denied).

The defendant has failed to offer any basis on which the court could consider a modification of the life insurance ordered by the judgment.

The motion is denied.
