Opinion

No. CV04 0104138 S

MEMORANDUM OF DECISION

Pursuant to Connecticut General Statutes § 52-500, the Court finds that the defendant has only a minimal interest in the subject property (5% as opposed to the plaintiff's 95%) and that a sale would not promote the interest of the owners.

The Court orders an equitable distribution of the property by the defendant transferring all his right, title and interest in the subject parcels to the plaintiff in exchange for just compensation in the amount of Forty-Three Thousand Dollars ($43,000.00).
