ORDERS RE MOTION #183, #184, #189


LLOYD CUTSUMPAS, JUDGE.

The plaintiff-father in this longstanding, bitter matter, filed a motion seeking a contribution towards private school tuition and extracurricular activity fees for the parties' 10-year-old minor child. In response, the defendant-mother filed a motion seeking sanctions for what she describes as frivolous, non-meritorious pleadings. The court-appointed guardian ad litem seeks an order and affirmation of his fees.

If the parties in this case spent as much time communicating or cooperating with one another regarding the rearing of their child as they have in litigating their discord, they would have saved tens of thousands of dollars they claim not to have, they would have avoided the time wasted on dozens of court appearances, and their child would be far better off. Instead, they persist in pursuing one another with a variety of legal motions which often appear to be nothing more than a continuation of the feud over their failed relationship.

The latest motion filed by the plaintiff is of little merit. On the other hand, the defendant's motion seeking sanctions, which has some merit, is unwarranted under the facts of this case. Lastly, the court-appointed guardian ad litem, whose fees have totaled approximately $37,000.00 over the seven-year life of the case, must be paid pursuant to the order described below.

Motion #183 seeking a contribution to education and activity expenses is denied.

Motion #189 seeking sanctions is denied.

Motion #184 seeking an order regarding guardian fees is granted. The court orders the plaintiff to pay $8,715.90 for previously ordered fees plus $750.00 for one-half of the fees incurred during the hearing on the above motions, for a total of $9,465.90. He is to pay said sum at the rate of $300.00 per month on the first of every month commencing April 1, 2008. The defendant is to pay $500.00 for previously ordered fees plus $750.00 for fees incurred during the hearing on the above motions for a total of $1,250.00. She is to pay said sum at the rate of $300.00 per month on the first of every month commencing April 1, 2008.
