ORDER

This case comes on for review before the Commission on respondent's motion to supplement the record.

After our consideration of respondent's motion and all other matters properly before the Commission, we find that respondent's motion should be denied.

While this case was on appeal to the Court of Appeals and after claimant had lodged the record on appeal, respondent filed a motion to supplement the record. Based on this motion, claimant filed a motion with the Court to remand this matter to the Commission for consideration of respondent's motion. The Court granted claimant's motion on August 23, 1995. Respondent's motion was eventually placed on the Commission's November 22, 1995 motion docket. However, on November 17, 1995, the Court dismissed claimant's appeal. Therefore, there is no longer an appeal to the Court for which the record can be supplemented. Thus, respondent's motion to supplement the record is moot.

Accordingly, we find that respondent's motion to supplement the record should be, and hereby is, denied.
