MEMORANDUM OF DECISION RE CITY'S MOTION FOR SUMMARY JUDGMENT

Pursuant to Practice Book § 17-47, it is the decision of this court that the motion for summary judgment is denied without prejudice. The defendants may refile a motion for summary judgment following discovery if the evidence elicited resolves the apparent conflict between the parties concerning the agreement of the parties as they entered arbitration and specifically, the extent to which the parties agreed to be bound. Per the plaintiff's request, he is granted an opportunity to obtain affidavits and to depose the attorneys who were involved in the arbitration agreement.
