Appeal, No. 35, March T., 1941, No. 1130 A. Misc. Docket, from judgment of Superior Court, April T., 1940, No. 242, affirming judgment of C. P. Armstrong Co., March T., 1938, No. 213, in case of W. J. Burke et ux. v. Mary Kerr. Judgment affirmed.

Interpleader proceeding.

The facts are stated in the opinion of the Superior Court, reported in 142 Pa. Super. 37.

Judgment entered for defendant in interpleader, opinion by RIMER, P. J., specially presiding. Plaintiffs appealed to the Superior Court which affirmed the judgment of the court below. Appeal by plaintiffs to Supreme Court allowed.

Error assigned, among others, was judgment of Superior Court.

The judgment is affirmed on the opinion of the Superior Court.
