Case No. 2:02-CV-919 TS (D. Utah May. 6, 2004)

Case No. 2:02-CV-919 TS

May 6, 2004

ORDER

BRIAN TED STEWART, District Judge

Plaintiff, Bradley Bird, filed a pro se civil rights complaint under 42 U.S.C. § 1983 while in the Duchesne County Jail. See 42 U.S.C.A. § 1983 (West Supp. 2003). Plaintiff's application to proceed in forma pauperis was granted. During screening, Plaintiff's complaint was dismissed under 28 U.S.C. § 1915 for failure to state a claim on which relief could be granted. However, the Court concluded that Plaintiff might be able to amend his complaint to state a Fourth Amendment claim against Defendant Lewis. Plaintiff was given thirty days to file an amended complaint or have his entire case dismissed. More than sixty days have now passed with no contact from Plaintiff.

Accordingly, IT IS HEREBY ORDERED that this case is dismissed.
