In an action to recover damages for medical malpractice, the plaintiff appeals from an order of the Supreme Court, Rockland County (O'Rourke, J.), dated May 30, 2001, which denied his motion to restore the matter to the trial calendar.

Peter E. Tangredi, White Plains, N.Y. (Stephen D. Chakwin, Jr., of counsel), for appellant.

Vouté, Lohrfink, Magro Collins, LLP, White Plains, N.Y. (Richard L. Magro of counsel), for respondent B. Richard Nunziata.

Rende, Ryan Downes, LLP, White Plains, N.Y. (Roland T. Koke of counsel), for respondent Peter C. Taylor Dickenson.

Before: ANITA R. FLORIO, J.P., SONDRA MILLER, LEO F. McGINITY, THOMAS A. ADAMS, JJ.

ORDERED that the order is reversed, without costs or disbursements, and the motion is granted.
