Berg v. Berg

Appellate Division of the Supreme Court of New York, First Department
Oct 2, 1951
279 App. Div. 555 (N.Y. App. Div. 1951)

Opinion

October 2, 1951.

Present — Peck, P.J., Glennon, Dore, Cohn and Shientag, JJ. [See post, p. 644, 655.]

Order unanimously modified by directing that until the trial of this action, the defendant be required to pay the rent, telephone, gas and electricity bills of the apartment occupied by plaintiff, the tuition of the children, and $75 per week for household expenses and by reducing counsel fee to $750 and, as so modified, affirmed. The action should be tried promptly. On this record the alimony and counsel fee granted by the Special Term are, in our opinion, excessive. Settle order on notice.
