THIS MATTER comes before the court on the Proposed Findings and Recommended Disposition of the United States Magistrate Judge [Docket No. 97]. No party having filed any objection to the Proposed Findings and Recommended Disposition; the court, having made a de novo review and a determination of the Proposed Findings and Recommended Disposition, and the court having further considered Plaintiff's request for Dismissal with Prejudice as to all parties [Docket No. 98],

FINDS: That the Proposed Findings and Recommended Disposition of the United States Magistrate Judge should be and hereby are adopted. IT IS HEREBY ORDERED that Plaintiff's Amended Complaint and this action are dismissed with prejudice as to all parties pursuant to Rule 41(a)(2), each party to bear his/her own costs and attorneys fees.

IT IS SO ORDERED.
