No. 97-03560.

Opinion filed May 12, 1999.

Appeal from the Circuit Court for Polk County; Charles A. Davis, Jr., Judge.

Michael H. Adams, Pro Se.

Robert A. Butterworth, Attorney General Tallahassee, and, Joseph H. Lee, Assistant Attorney General, Tampa, for Appellee.

Michael Adams filed a petition for writ of mandamus in the circuit court challenging a Department of Corrections order withholding 365 days of gain time. The circuit court denied the petition. We redesignate his appeal from the circuit court's order as a petition to a writ of certiorari and deny the petition. See Fla. R. App. P. 9.030(2)(B); Sheley v. Florida Parole Comm'n, 720 So.2d 216 (Fla. 1998).
