May 26, 2000
763 So. 2d 1218 (Fla. Dist. Ct. App. 2000)

Opinion

No. 1D99-3998.

Opinion filed May 26, 2000.

An appeal from the Circuit Court for Duval County. Brian J. Davis, Judge.

Nancy A. Daniels, Public Defender, P. Douglas Brinkmeyer, Assistant Public Defender, Tallahassee, for Appellant.

Robert A. Butterworth, Attorney General, Giselle Lylen Rivera Assistant Attorney General, Tallahassee, for Appellee.

We agree, and the state concedes, that the trial court erred in denying appellant's motion to withdraw his guilty plea. Accordingly, we reverse the adjudication of delinquency and the order of high-risk commitment, and remand the case for further proceedings.

REVERSED AND REMANDED.

ERVIN, VAN NORTWICK and BROWNING, JJ., CONCUR.
