Williams, $030553 Deputy Modification of Designation of Focus for Oral Argument(scheduled for February 5, 2013), and Supplemental Brief of Appellant Dear Mr. McGuire: In light ofthe Court’s January 11, 2013 request for further briefing on appellant’s Batson/Wheeler argument, appellant hereby modifies his Designation of Focus for Oral Argument. Consistent with the Court’s recent focus on appellant’s Batson/Wheeler argument, appellant now designates as his focus for oral argument the following two arguments: Argument I in appellant’sopening brief regarding Batson/Wheelererror (pp. 66- 112); ArgumentII in appellant’s opening brief regarding the trial court’s error in excusing prospective juror Reheis (pp. 113-126). (ArgumentII, above, was previously designated asthe first argument of focus in counsel’s letter to the Court dated January 15, 2013.) Also, please find enclosed a Supplemental Brief of Appellant, with Motion for Leave to File, and supporting Declaration. The Supplemental Brief addresses additional issues raised by the Court’s requestforletter briefs, dated January 11, 2013, and the letter brief filed by Respondent on January 23, 2013 pursuant to that request.
